Successfully defended an elderly woman against an anti-privacy claim brought by a production company that alleged that she illegally downloaded pornography from a peer-to-peer filesharing platform.
Breach of Contract:
Defended China State Construction Engineering Corporation Ltd. and China Construction American against BML Properties Ltd. in a breach of contract dispute related to the construction and development of the luxurious Baha Mar Resort.
Consumer Protection:
Successfully defended Transnational Foods, Inc. against consumer protection claims related to the labeling of the company’s extra virgin olive oil.
Construction:
Represented AECOM Technical Services, Inc. in its “protest” of a $100 million construction contract awarded to Jacobs Engineering by the Los Angeles Community College District.
Corporate Governance:
Successfully represented church parishioners who were excluded from participation in church services, participation in decisions on control and governance of the church, participation in decisions on church expenditures, and participation in elections of members to the Board of Directors.
Fraud:
Successfully represented cruise ship passengers in a lawsuit against Almod Diamonds Ltd., Diamonds International, and Royal Caribbean Cruise Lines Ltd. for breach of contract, fraud, and violations of consumer protection statutes related to the sale of sham diamond jewelry.
Intellectual Property:
Successfully secured damages and a declaratory judgment for popular funk band Cameo in a lawsuit against their former manager and group member for copyright and trademark infringement.
Medical Malpractice:
Successfully limited a medical provider’s liability for a $2,000,000 medical malpractice claim related to complications from a second-trimester surgical abortion.
Products Liability/Toxic Torts:
Represented E. I. du Pont de Nemours & Co. in an MDL of more than 3500 cases that involved injuries caused by the unauthorized release of the toxic chemical Perfluorooctanoic Acid (“PFOA”) into the local air and water streams.
Professional Liability:
Successfully represented Miami Beach Community Health (“MBCHC”) in an accounting malpractice action against accounting firms McGladrey and CohnReznick for fraud and negligence claims related to MBCHC Chief Executive Officer Kathryn Abbate’s embezzlement of $6.8 million.
Sovereign Litigation:
Successfully defended the Palestinian Liberation Organization and Palestinian Authority against Anti-Terrorism Act civil claims brought by the American families of victims who died as the result of terrorist acts committed by former PLO/PA officials.
